SportzTipz^™ – Website Terms & Conditions Last updated: February 2026 1. Acceptance of Terms By accessing or using the SportzTipz^™ website or Web Application ("Website" or "Web Application"), you agree to comply with and be bound by these Terms & Conditions. If you do not agree with these Terms, you must not use the Website. SportzTipz^™ ("SportzTipz^™", "we", "us", "our") provides online sports tipping competitions for entertainment purposes only. You must be at least 18 years of age to register or participate. 2. Nature of Service SportzTipz^™ provides online sports tipping competitions for recreational and entertainment purposes only. We do not provide: - Gambling services - Betting services - Wagering products - Financial or investment advice Participation in competitions does not guarantee prizes or financial gain. Users participate at their own risk and are solely responsible for their tipping selections. 3. User Accounts To participate in competitions, you may be required to create an account. You agree to: - Provide accurate and complete information - Keep your login credentials confidential - Accept responsibility for all activity under your account We reserve the right to suspend or terminate accounts that breach these Terms. 4. Competition Rules Specific competition rules (including entry fee plus donations, prize pools, scoring systems and deadlines) will be published within the Website or Web Application. By entering a competition, you agree to: - Abide by all published competition rules - Accept scoring outcomes as final - Accept our determination of results in the event of disputes We reserve the right to amend competition rules where reasonably necessary. You are responsible for ensuring that your participation complies with the laws of your State or Territory. 5. Entry Lock and Pick Deadlines Participants must submit their selections (tips) before the applicable round or match deadline which is thirty (30) minutes prior to the scheduled match. Once the deadline has passed, selections for that match or round will be locked and cannot be changed. Participants are responsible for ensuring their selections are submitted correctly before the deadline. We are not responsible for incomplete, late, or unsuccessful submissions caused by: - User error - Internet connectivity issues - Device problems - Circumstances outside our reasonable control Where a technical error materially affects the fairness or operation of a competition, we may take reasonable steps to correct the issue. 6. Payments, Entry fee plus donations and Refunds 6.1 Payments Where competitions involve entry fee plus donations: - Payments are processed through Stripe or other third-party payment providers - We do not store credit card details - Payment processing is subject to the terms of the payment provider We are not responsible for delays caused by banks or third-party payment systems. 6.2 Refunds All entry fee plus donations or payments made to participate in competitions are non-refundable, including for change of mind, once payment has been successfully processed. Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law, including rights to a refund or other remedy where services have a major failure or do not comply with consumer guarantees. Where a refund is issued: - Any payment processing fees charged to us by Stripe are non-recoverable - These fees may be deducted from the refunded amount, meaning the amount returned may be less than the original payment. 7. Prize Pool and Payouts Any prize pool advertised for a competition is based on the rules and structure published within the Web Application. Prize amounts, payout structures and eligibility requirements will be displayed before or during the competition. Prizes will be awarded to eligible participants based on the final leader board or scoring results determined by the Web Application at the conclusion of the competition. If a tie occurs: - Prizes may be split equally between tied participants unless otherwise specified in the competition rules. Participants are responsible for ensuring their account and payment details are accurate to receive any prize payments. We reserve the right to verify the identity and eligibility of prize winners before issuing prizes. We may withhold prizes where evidence of fraud, misconduct or breach of these Terms is suspected. 8. Leader board and Scoring Scores, results and leader board rankings are determined by the scoring system and data sources used by the Web Application. While we aim to ensure accuracy, the Web Application’s scoring calculations and leader board results are considered final unless we determine, acting reasonably, that an error has occurred. If a material scoring error is identified, we may correct the error and update rankings, results or prize allocations as reasonably necessary. 9. Competition Changes or Cancellation We reserve the right to modify, suspend or cancel competitions where reasonably necessary, including due to: - Technical issues - Errors or system failures - Fraud or integrity concerns - Circumstances beyond our reasonable control If a competition is cancelled before it begins, participants may be eligible for a refund of entry fee plus donations less any non-recoverable payment processing fees, unless otherwise required by law. If a competition has already started, we may take reasonable steps to continue, modify or fairly conclude the competition. Nothing in this clause limits rights under the Australian Consumer Law. 10. Account Suspension and Fair Play Participants must not engage in conduct that undermines the fairness or integrity of competitions. Prohibited conduct includes but is not limited to: - Creating multiple accounts - Using automated tools or bots - Manipulating results - Colluding with other participants - Attempting to exploit technical errors We reserve the right to: - Suspend or terminate accounts - Remove entries - Disqualify participants from competitions Where this occurs, entry fee plus donations may be forfeited unless otherwise required under the Australian Consumer Law. 11. Privacy We are committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Information We Collect We may collect: - Name - Email address - Username - Payment-type information - IP address and device information - Competition selections and activity Purpose of Collection We collect personal information to: - Administer competitions - Process prizes - Communicate with users - Improve services - Comply with legal obligations Disclosure We may disclose personal information to: - Payment providers - Regulatory authorities where required by law We do not sell personal information. Indemnity You agree to indemnify and hold harmless SportzTipz^™ from any claims, damages, liabilities, costs or expenses arising from: - Your breach of these Terms - Misuse of the Website - Violation of any law - Infringement of third-party rights 17.
